Terms and conditions of sale:
Conditions hereby are concluded between two parties. First party is:

And the other party is any moral or natural person who confirms an order via NEWDEKOR’s website: http://www.newdekor.com
Proprietary • VAT not applicable (Art. 293 B du CGI) If any of the hereby conditions was not fulfilled, both parties should refer to mail order selling customs and laws applicable to any company with headquarters established in France.
Purpose:
The purpose of the conditions hereby is to set out the terms of sale between NEWDEKOR and the User, from the order placement to the payment and to the delivery. Any Product ordered via the Site presupposes having read and expressly agreed these terms and conditions of sale. The conditions hereby apply exclusively to natural persons who are not professional traders as defined by the consumption Code and who are purchasing for their personal needs only.
NEWDEKOR reserves the right to amend these conditions of sale at any time. In this case, applicable conditions of sale shall always be the current conditions at the date of order placement.
Features of goods displayed:
Products are those displayed on the website. Pictures and technical features displayed on the website are as faithful as possible to the product offered, but cannot ensure a perfect similarity with the original, especially in colours.
Order placement:
The user is enabled to place her/his order via the website. All prices are posted in euros, delivery expenses are excluded and shall be billed in addition, and shall be calculated before the order being confirmed. Payment shall be made by credit card at the date of the order placement, possibly via PayPal secure bank’s server. Consequently, none of the buyer’s bank data will pass through NEWDEKOR website. Therefore, the payment with credit card is totally secure; this is the reason why bank data are still requested for every purchase made. Your order will be registered and confirmed as soon as the payment is accepted by the bank.
People who own a bank account in France are allowed to place orders on NEWDEKOR website with check payment. The date when the payment is received will be the date of order confirmation according to online sales conditions.
Prices:
All prices are posted in euros. NEWDEKOR reserves the right to change any price at any time; however, to be applicable, the price will be billed based on prices in force when the order is placed.
Prices displayed do not include delivery expenses that shall be billed in addition and shall be calculated before the order is confirmed.
Payment of the price shall be made at the date of the order placement. At no time any of these payments can be considered as a deposit or a part payment.
Availability of products and product warranty:
Order will be fulfilled as soon as possible. In case of damage or loss, the buyer will be notified as quickly as possible and she/he will be allowed to cancel Her/his order. The user will be entitled to ask (a) for a complete reimbursement of the payment made within 30 days top, or (b) for another product of the catalogue with the same value. Products are second-hand goods; they are sold in the same condition described in the features datasheet, under no guarantee.
Order confirmation:
Contractual data will be confirmed via e-mail after the order form is accepted and validated.
Delivery:
Orders that must be delivered out of Europe (such as USA, Asia, Russia, Africa, etc.) will be validated only after the buyer has issued a request for an estimate and accepted the amount of the delivery expense.
Products are delivered to the address provided with the order. But the bill will be sent to the invoicing address if the user has validated this option in the order form. NEWDEKOR is not liable for any loss, damage or delayed delivery due to the carriage. Do not accept the delivery if the parcel is damaged or is proved having been opened, otherwise no claim will be accepted. You must open and check it in the presence of the carrier. If the goods are damaged, we advise you to refuse the delivery and to notify “delivery refused for damage » on the waybill. If the parcel is proved to have been opened and if some items are missing you must refuse the delivery, draw a report of despoliation in the presence of the carrier and send us a copy before we proceed to any reimbursement or replacement.
The proof:
The buyer’s data are compiled and saved by NEWDEKOR computer systems under reasonable conditions of security and are considered as proofs of communications, orders and payments made between both parties. The filing of order bills and invoices is made on secure and durable storage medium in order to provide the most reliable and faithful copy.
Revocation:
The Buyer has a period of seven (7) business days to return, at his or her expense, the Product(s) ordered if, for one reason or another, the Buyer is not satisfied with them. This 7-day period runs from the Product reception date (as attested by date on postmark). Any return of product to us shall be first agreed by our customer service department who will deliver to the consignee an authorization ID. Any return of product to us which effected without our agreement will be refused. The consignee shall return the product at his/her own expense which will include any custom taxes or duties, under insurance coverage for France in case of any loss or damage. The product shall be returned in the same condition it was received and in its original package to the following address:

Refunding will be effected within 7 days starting with the time of delivery of the returned product. Copies of all transportation and insurance statements shall be sent to NEWDEKOR by the buyer. The revocation right ends if the parcel has not been sent back to us before the 7-days delay expires. At that time, the product becomes the property of the Buyer. No reimbursement or replacement will be made if the product is incomplete, damaged, modified or if the original packaging is damaged. Once the return of the product has been authorized by us, the buyer will have the choice to ask for reimbursement of the paid amount, replacement of the product, or discount voucher. In case of replacement, the delivery will be at his/her expense. To facilitate the order process thanks to notify the original order number and your complete customer ID.
Liability:
NEWDEKOR is not liable for any damage or incident caused by the use of the Internet network such as service breakdown, virus or external intrusions or any other case qualified by courts as a case of force majeure.
Legal information:
Buyer’s personal data are requested to proceed correctly with the orders, invoices and guarantee contracts. A lack of information will cause the abortion of the ordering process. Pursuant to the Act 78-17 dated 6 January 1978 on data processing, files and individual liberties, any personal information gathered on the Site is registered with the French CNIL (Commission Nationale de l'Informatique et des Libertés, or National Committee on Computerization and Individual Freedoms). In accordance with the Data-processing Law and Freedoms published in the Official Journal dated 6 January 1978 (Art. 34), the Buyer has a right of access, of correction, and opposition to the personal data relating to it. The firm NEWDEKOR commits itself not to reveal the information communicated by the Buyer and the visitor of the site. This information is confidential and will be used only for the handling of the order.
Legal protection of data and databases:
According to Act 98-536 dated July 1st 1998, transposing the intellectual property code directive 96/9/CE dated 11 March 1996 about legal protection of databases, NEWDEKOR is the source and the owner of any data used in its website databases. Therefore, all the texts, comments, works, illustrations and images of this website are protected by all proprietary rights (intellectual proprietary, copyright etc.) worldwide, as stipulated in the above mentioned law.
Therefore, only a private use is authorized. All other use will be sanctioned. All reproduction (total or partial) is strictly forbidden. The photographs and texts of this website are contractual.
Applicable duty and litigations:
The relations between the firm NEWDEKOR and its customers are subjected to the French law.
In case of litigation, the buyer is invited to contact the firm NEWDEKOR for an amicable agreement. If the negotiations break down, only the court of Toulouse (France) is qualified.
Compliance with safety measures:
Concerning all Vallauris and Monaco lamps and all antiques, we have removed on purpose original electrical equipments (such as connections and cables) because they do not comply with current safety norms (NFC15-100).
